Arrest Procedures, Miranda, Search, Booking, and Evidence


1. ARREST STANDARD


An arrest requires probable cause that a person committed a crime. Deputies shall be able to explain the facts supporting the arrest.

2. PROBABLE CAUSE


Probable cause may be based on:
A. Deputy observations.
B. Victim statements.
C. Witness statements.
D. Physical evidence.
E. Video evidence.
F. Suspect admissions.
G. Reliable dispatch information.
H. Database returns.

3. MIRANDA WARNING


Miranda is required before custodial interrogation. A subject in custody who is questioned about the crime should be advised of rights.

Suggested roleplay wording:
"You have the right to remain silent. Anything you say can and will be used against you in court. You have the right to an attorney. If you cannot afford one, one will be provided for you. Do you understand these rights?"

4. SEARCH INCIDENT TO ARREST


After lawful arrest, deputies may search the arrestee and immediate reachable area for weapons, evidence, contraband, and means of escape.

5. HANDCUFFING


Handcuffs should be checked for fit and double-locked when practical. Handcuffing does not automatically mean arrest if used during a lawful detention for safety.

6. PRISONER TRANSPORT


Before transport:
A. Search prisoner.
B. Search rear seat.
C. Seatbelt prisoner when practical.
D. Notify dispatch starting transport.
E. Monitor prisoner.
F. Search rear seat again after transport.

7. BOOKING REPORTS


Booking reports should include:
A. Suspect name.
B. Charges.
C. Probable cause.
D. Evidence.
E. Victim/witness information.
F. Medical issues.
G. Force used if any.

8. EVIDENCE HANDLING


Evidence shall be identified, collected, logged, and preserved. Deputies shall avoid unrealistic evidence claims. Evidence should support RP and reports.

9. CHAIN OF CUSTODY


Each transfer of evidence should be documented. Evidence logs shall include item, location found, who collected it, time/date, and case number.

10. PROPERTY


Found property, recovered stolen property, weapons, narcotics, and seized items shall be documented in the report.
